$650,000

The Case

A 41-year-old warehouse worker suffered severe back injuries when a forklift operator struck a storage rack, causing heavy inventory to collapse onto our client. The accident occurred at a distribution center in Buford, Georgia. Our client sustained two herniated discs, a compression fracture of the L4 vertebra, and significant nerve damage that caused radiating pain and numbness in both legs. He required spinal fusion surgery and was unable to return to his warehouse position, which had been his primary source of income for 15 years.

The Challenge

While our client was entitled to workers' compensation benefits, those benefits alone were insufficient to cover his full losses. Workers' comp in Georgia does not compensate for pain and suffering and limits wage replacement to two-thirds of average weekly wages. The key challenge was identifying a viable third-party claim. We investigated and discovered that the forklift operator was employed by a separate staffing agency, not by the warehouse company, opening the door to a third-party negligence claim against the staffing agency. The staffing agency argued the forklift operator was properly trained and that the storage rack system was defectively designed.

The Result

Our investigation revealed that the staffing agency had failed to verify the forklift operator's OSHA certification, which had actually expired six months before the accident. Internal emails showed the agency was aware of the lapsed certification but assigned the operator to the warehouse anyway to fill a staffing shortage. We also obtained training records showing the operator had received only minimal instruction on the specific forklift model used at the facility. The combination of the workers' compensation claim and the third-party negligence claim resulted in a total recovery of $650,000 -- far exceeding what workers' comp alone would have provided.
